For your information, please be aware that the companyPLANELLA FERRER, S.L. (hereinafter referred to as “HOSTAL CUBA”) is the DataController in charge ofyour personal data.

This company has its registered office at 1, San Magi, Street, 07013, Palma de Mallorca, and holds Spanish tax identification CIF B57784423.

2.- DATA COLLECTION: What kind of data do we collect and how do we obtainthem?

The personal data that HOSTAL CUBA processes consists ofpersonal data collected through the forms provided on the website and alsoduringthe check-in in order to registereither customers or third parties.

The data collected byHOSTAL CUBAare the following: first name and surname, date and place of birth, nationality and identity document, e-mail address, home address,payment medium data and signature. Other data may also be obtained if provided by the customer  explicitlyfor the purpose offulfilling special requests.

HOSTAL CUBA may also collect customer data throughthird parties when customers give theirexpressconsent on the various social mediaor when they have so stated through travel agencies, OTAs ortour operatorsthat sell overnight stays at the HOSTAL CUBA.

In connection with the data collected as stated in the previous paragraph, HOSTAL CUBA will only collectthe name and the email addressin the first case, whereas in the second case the data collected will be any that which is essential for the provision of services that have been requested.

HOTEL HOSTAL CUBA will also collect the e-mail addresses of both guests and non-guests who access the Internet through the hotspot located at the rooftop Skybar or in the restaurant for the purpose of providing them with Internet service.

Unless expressly provided to the contrary, all the information requested in the forms must be completed, and,in particular thedata subject’s explicit consent clause.In case of failure toprovide any of the data that is marked asmandatory, HOSTAL CUBA, depending on the circumstances, maydecide not to proceed with the concerned request.

HOSTAL CUBA will also be able to collectimagesfromsecurity cameras installed inthe reception and common areas. HOSTAL CUBA will inform Users of the existence of such cameras by displaying information signs and advising themthat images are recorded in the premises, as well as concerning the possibility to exercise the corresponding rights.

3.- PURPOSE AND LEGAL GROUNDS FOR DATA PROCESSING: What do we use your data for?

HOSTAL CUBA informs data subjects that theirpersonal data will be used by the companyPLANELLA FERRER, SL, for the following PURPOSES:

i. Processingof Users’requests

HOSTAL CUBA will onlyprocess the data insofar asit is necessaryin order tofulfil User´s information requestsor to provide the contractedservices. Therefore, we will process data such as your first name, surname(s), home address, e-mail address, telephone number and, if applicable, credit card details. Data processing will only take place if HOSTAL CUBA has obtained the User’s explicit consent and provided that the processing is necessary for the performanceof the contract to which the data subject is a party or for the implementationof pre-contractual measures at the User’s request.

HOSTAL CUBAwill also process the Users’ information that is requiredin ordertohandleany incidents that may be reported to or detected by HOSTAL CUBA. This data processing will only be carried out in order to properly addresssuchincidents or to solve anyproblems arising from them.Such processing is essential in order to satisfy the legitimate interests of HOSTAL CUBA and to meet the Customer’s needs.

ii. Sending of reminders in case of non-completion of bookings.HOSTAL CUBA may, withthe User’sexpress consent, may send them reminders about the non-completion of a bookinginitiated by the data subject, on the basis of the informationthat the Usermay have provided through the website.

HOSTAL CUBA shall be entitled to carry out such processing only with the explicit consent of the data subject.

iii. Analysis of customer interactions with our website. HOSTAL CUBA may process the personal data of website Users,employing for that purpose their IP or MAC address in order to analyse interactions, movements, scrolls, visits orproduct inquiries thatthe User may have madeon ourwebsite.

This processing is essential in order to satisfy the legitimate interests of HOSTAL CUBA.

iv. Website computerised control, system incident reporting and management of the same. HOSTAL CUBA will performany surveillance and control actions regarding website use that are necessary in order to prevent and detect any fraudulent use, non-authorised access, alterations or loss of personal or non personal information.

HOSTAL CUBA is entitled to carry out this processing for the purpose ofcomplying with the legal requirementsset forth inthe Spanish Law onthe Information Society and Electronic Commerce, as well as to satisfy the legitimate interests of HOSTAL CUBAinguaranteeing network and data security.

v. Handling of requests concerning data protection rights and incident reporting.Based on the forms provided by HOSTAL CUBA, HOSTAL CUBA will process personal data in order tofulfilour customers’requests.

vi. Processing of images obtained throughsecurity cameras. HOSTAL CUBA has installed security cameras with the aim ofguaranteeing our customers’security within the premises, as well as to control access to the hotel.

This processing is essentialin order to satisfy the legitimate interests of HOSTAL CUBA.

vii. - Sending advertisements both to guests and non-guests in order to provide them with free internet access within the Hotel, at the Restaurant and the Skybar. – Subject to the express consent of the data subject, the latter may access the Internet through the hotspot provided by HOTEL HOSTAL CUBA, which will only collect the e-mail address. HOTEL HOSTAL CUBA may use this data to send advertisements as long as this authorisation is not withdrawn.

viiI.- Job application management -  In case that personal data is provided through the “WORK WITH US” section, HOSTEL CUBA will collect the first name and surname, e-mail address, telephone number, position for which the candidate is applying and the datacontained in the curriculum vitae provided by the same candidate. This data will be solely collectedfor the purpose of processingcandidates´applications for any possible job offers.

HOSTAL CUBA is entitled to carry out this processingby virtue ofthe User’s express acceptance.

4.- DATA RETENTION

The personal data to which HOSTAL CUBA is given access will be processed for as long as it is necessary to do so in order to fulfil the purpose for which such datawas collected. The data pertaining to the customer´s credit card will be deleted once the checkout has been successfully completed and all outstanding amounts have been settled.

Notwithstanding the foregoing, HOSTAL CUBA will continue to store suchpersonal data, duly blocked,afterthey are no longer relevant for the purposes for which such data was collectedfor the purpose of making it available to the competent Public Administrations, Judges and Courts or the Public Prosecutor´s Office until such time as any actions that may arise from relationship with the customer become time-barred and/or the statutorydata retentionperiod expires. After the expiration of thesedeadlines, the data will be deleted.

The images recorded by the security cameras installed at the premiseswill be storedfora maximum periodof one month from their recording and will be deleted after the expiration of the aforesaid period.

The data provided in order to access the Internet through the hotspot will be kept for the purpose of sending marketing information as long as the authorisation is notwith drawn.

5.- DATA TRANSFER

HOSTAL CUBAmay transferyour personal data to:

· Third party contractors,upon the User´s express request.

· Competent public authorities,law enforcement agencies, judges and courts, upon their request.

In addition to the above-mentioned data transfers, HOSTAL CUBA cooperates with third party service providers who have access to customers’personal data and who process such data in the name and on behalf of HOSTAL CUBAin connection with the provision of their services. 

6.-EXERCISE OF RIGHTS

Data subjects may exercise their rights to access, rectification anderasure; they may also request the restriction of processing of their personal data, object to such processing, request the portability of their data, as well as exercise their right not to be the subject to a decision based solely on automated means, as follows:

Data subjects may filea complaint with the Spanish Data Protection Agency if they do not find HOSTAL CUBA’s reply satisfactoryin connection withthe exercise of their rights.

In any event, Users are hereby informed that the handling of complaints concerning personal data processing is the responsibility of the Data Protection Officer of HOSTAL CUBA, with registered office at the 1, San Magi Street 07014, Palma de Mallorca.
